This policy explains how Minh Tam Agricultural Development Joint Stock Company (“Minh Tam”, “we”) handles the personal data you give us through ptnnminhtam.com.vn, under Vietnam's Personal Data Protection Law No. 91/2025/QH15 and Decree 356/2025/ND-CP. It applies from the day it is posted on the website.
1. Who is responsible for your data
The data controller and processor is Minh Tam Agricultural Development Joint Stock Company, business code 4000848189, Lot A2, Que Cuong Industrial Cluster, Que Son Trung Commune, Da Nang City, Vietnam.
Contact for personal data: email ptnnminhtam@gmail.com, hotline 0812 492 555, office 0235 3902 555.
2. What we collect
Contact, quote and partnership forms: your name, phone number, email (optional), company or dealer name, area, the product you are interested in, the expected quantity and what you write.
Job applications: your name, phone number, email, year of birth, where you live, your introduction and your CV file.
Feedback: your feedback, rating, attached photos and any details you choose to give (your role, province, product, crops, farm size, timing). Your name, phone number and email are stored only if you leave them. For feedback, we do not store your IP address or browser, and we remove location data from photos.
Details sent with contact forms and applications: your IP address, browser type and the page you sent the form from.
Proof of consent: when you agreed, and the consent sentence you ticked.
Server logs: these may include the time, address visited and error codes, kept for a short time to run the site and fix faults.
Visitors do not need an account.
3. Why we use it, and on what basis
To answer your request, advise on products, send quotes and handle dealer and partnership requests.
To review job applications and arrange interviews.
To receive feedback, talk to you about it where needed, and improve our products and service.
To stop spam and abuse and protect the website.
The basis is your consent, given by ticking the box on the form. The box is never ticked in advance, and each form only asks consent for that form's purpose. We process data without consent only where Article 19 of the Law allows it, such as to carry out an agreement with you or where the law requires it.
We do not use form details for advertising or promotions without your separate consent. We do not buy or sell personal data.
4. What not to send us, and your responsibility
We do not ask for sensitive personal data such as ID card images, health details, religion, political views or bank details. Please leave them out of your CV, message and photos. If you send them anyway, they are sensitive personal data under the law: we use them only for that form's purpose, limit who can see them and may delete what is not needed.
You are responsible for making sure what you send is complete and accurate. If you send someone else's details or photo, you must have the right to or their agreement. We are responsible for how we handle data once we receive it; you are responsible for what you choose to send.
5. Children
This website and its forms are not meant for children under 16. If you are under 16, please do not send your details; a parent or guardian can contact us instead. If we learn that we hold a child's details without a legal representative's consent, we will delete them.
6. Who can see your data
Minh Tam staff assigned to the task (sales, customer care, HR), through accounts with the right permissions. Applications and CVs can be seen only by people with recruitment rights, and each time a CV is opened it is logged. Feedback can be seen only by people given that specific permission.
Infrastructure providers: Amazon Web Services (AWS) provides the server, and an email provider is used when the website notifies staff. They provide technical services under contract.
Competent state authorities, where the law requires it.
Anyone else, only with your consent or where the law allows it.
7. Storage abroad
The website and database run on Amazon Web Services servers in Sydney, Australia. This means the data you send through the website is transferred to and stored abroad, in Australia, on Amazon Web Services infrastructure, to run the website and for the purposes in section 3. Minh Tam remains responsible for this data.
If you do not want your data stored abroad, you can call the hotline or visit the office instead of sending a form.
8. How long we keep it
Contact, quote and partnership requests: up to 24 months after our last exchange.
Feedback: up to 24 months after it was last handled.
Job applications: deleted within 6 months of being sent if you are not hired. If you are hired, your application is kept under the labour rules.
IP address and browser: 90 days.
Backups: deleted data leaves the backups within 14 days.
We may keep data longer, as far as needed, where the law requires it or to deal with a complaint or dispute under way.
9. Security
The website uses encrypted HTTPS connections. Only accounts with the right permissions can reach the data, passwords are not stored in readable form, CVs and feedback photos are not public, and data is backed up daily. No system is completely secure, so we cannot promise that, but we take the necessary measures.
If there is a data breach, we will notify the competent authorities as required, and tell the people affected where the law requires it or where this helps them protect themselves.
10. Your rights and duties
You have the right to know about the processing of your data; to consent, refuse or withdraw consent; to view and correct your data; to ask for your data to be provided, deleted or restricted, or to object to processing; to complain, denounce, sue and claim compensation as the law provides; and to ask for protective measures.
You have a duty to protect your own data, respect other people's data, give complete and accurate information, and follow personal data protection law.
11. How to make a request, deadlines, and when we may refuse
How: send an email or letter to the address in section 1 with your name, the phone number or email you used, your reference code (YC…, UV…, GY…) if you have one, and what you want. Requests to withdraw consent or restrict processing must be in writing, including electronically. We may ask for just enough information to confirm it is you. Anonymous feedback can only be found by its code.
Deadlines: we reply within 2 working days of receiving a request made through this procedure, and finish within:
10 days for requests to view, correct or provide data;
15 days for requests to withdraw consent, restrict or object to processing, or apply protective measures;
20 days for requests to delete data.
These run longer where a processor or third party has to act, and can be extended once as the rules allow; we will tell you why.
When we may refuse, or do only part of a request: we will give our reasons in writing, in the cases the law allows, including where:
the request would affect Minh Tam's lawful rights and duties, or infringe the lawful interests of the State or others;
the data is processed under a case that needs no consent, or the law requires us to keep it;
providing the data could harm national defence, security, public order, or the life, health or property of others;
it cannot be done for a legitimate reason;
the request abuses data subject rights, going beyond what is needed or against their purpose, in a way that hinders lawful business. The law penalises this.
Withdrawing consent does not affect processing already done. After you withdraw consent or have your data deleted, we may no longer be able to answer your request or consider your application.
12. Cookies and storage on your device
This website uses no tracking or advertising cookies. The login cookie is for staff accounts only. The fertilizer calculator and season calendar remember your land unit and province in your own browser; this is not sent to our server, and you can clear it in your browser. Any product view statistics are hourly totals only, not linked to any visitor.
The Contact page shows a Google Maps map, and some articles may show YouTube or Facebook videos. When these load, your browser connects directly to those companies and their policies apply.
13. Complaints
If something is not right, please contact us through section 1 so we can sort it out faster. This is an invitation, not a condition: you can still complain or denounce to the specialised personal data protection agency of the Ministry of Public Security, or sue in court, as the law provides.
14. Changes and effect
We may update this policy when the website or the law changes, and we show the date of the update on this page. If a change needs your new consent, we will ask for it; continuing to use the website does not count as consent.
This policy is read and applied under Vietnamese law, and mandatory provisions of law prevail. The Vietnamese version is the official one, and the English version is for reference.
